What is clearly in or legal for you to copy on my behalf

 

Avid TechDVD-VADA Can copy your own home movies made by your self or a member of your family.Content can include anything from a wedding to a travel video of your holiday overseas as an example. If you are an organisation representative and have permission from an authorised officer of your organisation.


Can Avid TechDVD-VADA transfer my home made video  that contains nudity, adult or explicit imagery?

Anything that is clearly illegal or you reasonably ought to know is illegal, violent, racist, cruelty  to animals or offensive to common decency.

We do not need to provide an explanation for refusal and retain the right to refuse any material for any reason  as we see fit without reference to you. If you think it may be illegal you are probably correct and you must not send it us to convert.



Can I copy a Hollywood movie I own into a new format?“


Short Answer is - NO


If you want to reproduce a commercially available movie that is protected by copyright you will need permission from the copyright owner unless all the copyrights have expired (doubtful) or a special exception applies. Converting a movie to a new format will involve making a reproduction of the movie; this is something only the copyright owner has the right to do. The fact that you own a physical copy of the film does not confer to you the right to copy the movie into a new format.


What is a copyright movie?


Any move you purchased or could purchase in a retail store, including rental or vhs videotapes and dvd's.


This same restriction applies to television or cable-satellite broadcasts or digital media downloaded from the internet.



Might I have permission or a right under the Copyright Act Australia?

Can AVID TECHDVD -VADA help me to obtain copyright permission?


NO, we have no direct connection that could assist you.


Can I make a copy of any  commercial DVD-R ? 


You cannot record video with CSS (Content Scrambling System) encryption protecting the content. Most commercial movies available on DVD and videotape are copy protected and many DVD recoders recognise and prevent or reduce your ability to make a copy.



What am I allowed to copy onto disk? 


You can record copyrighted music and other material for personal use (for example, broadcasts, CDs, cassettes, records, musical performances, etc.) in your own home (Sony Beta case). If you intend to sell, transfer, distribute, or lease a disK recorded from any of these sources, or if you use it as part of your business, you must get permission from the copyright owner,Avid TechDVD can not do this for you except where our license grants us a right from AMCOSS-ARIA for music transfers.


When you order from Avid TechDVD you must complete an order form which has a copyright disclaimer and indemnity to protect us from any legal action, you would be expected to indemnify Avid TechDVD and VADA for any consequential action.


Since we have no control over media sent to us by or to you the customer an indemnity is essential.

It is not permissible to copy-reproduce media produced by these companies since the methods and techniques or softwares may have contingent obligations and licence limitations or conditions which neither Avid Tech or Video and DVD Australia may be able to confer onto to end users.


Public performance of any music added or created irrespective of any royalty free licence extension does not confer any such right to performance in public.
